The Academy of Laser Dentistry website that is intended to provide useful information for ALD members, consumers and other interested persons. The following Terms of Use outline your obligations when using the ALD website. You can also review our Privacy Policy which outlines our obligations and practices towards handling any personal information that you may provide to us.

  1. ACCEPTANCE OF TERMS

The web pages available at laserdentistry.org (“Site”), are owned and operated by the Academy of Laser Dentistry (“ALD”) and is accessed by you under the Terms & Conditions of Use described below (“Terms & Conditions”).

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING THIS SITE OR USING ANY PART OF THE SITE OR ANY CONTENT OR SERVICES (AS EACH IS DEFINED BELOW) ON THE SITE, YOU AGREE TO BECOME BOUND BY THESE TERMS & CONDITIONS. IF YOU DO NOT AGREE TO ALL THE TERMS & CONDITIONS, THEN YOU MAY NOT ACCESS THE SITE OR USE THE CONTENT OR ANY SERVICES IN THE SITE.   1. MODIFICATIONS OF TERMS & CONDITIONS

The ALD reserves the right, at its sole discretion, to modify or replace the Terms & Conditions at any time. If the alterations constitute a material change to the Terms & Conditions, ALD will notify you by posting an announcement on the Site. What constitutes a “material change” will be determined at ALD’s sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Services by you following such notification constitutes your acceptance of the Terms & Conditions as modified.

  1. DESCRIPTION OF SERVICE

Subject to full compliance with the Terms & Conditions, ALD may offer to provide certain services and content, as described more fully on the Site, (“Services”). Services shall include, but not be limited to, the offering of any information and materials displayed, transmitted or performed on the Site or through the Services (including, but not limited to text, user comments, messages, information, data, graphics, news articles, photographs, images, illustrations, software, audio clips and video clips, also known as the “Content”). ALD may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. ALD may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. While it is the ALD’s intent to always present accurate information, the Academy of Laser Dentistry makes no warranties regarding the correctness of the information provided on this site. The Academy does not endorse, approve or certify such information, nor does it guarantee the accuracy, completeness, efficacy, timeliness, or correct sequencing of such information. The Academy of Laser Dentistry accepts no liability for damages of any kind resulting from reliance on any of the information provided therein. By proceeding to use this service, each user expressly waives any and all rights of action that he or she may have against the Academy of Laser Dentistry arising out of use and/or reliance on the information on this service.

  1. YOUR REGISTRATION OBLIGATIONS

As a condition to becoming a registered Member, you are required to register with ALD and select a password (“ALD Password”). You shall provide ALD with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms & Conditions, which may result in immediate termination of your ALD account. ALD reserves the right to refuse registration of, or cancel your membership in its discretion. You shall be responsible for maintaining the confidentiality of your ALD password.

  1. REGISTERED USER CONDUCT

As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms & Conditions, or any other purpose not reasonably intended by ALD.
By way of example, and not as a limitation, you agree not to use the Services:

  1. to post or transmit, or cause to be posted or transmitted, any Content that is untrue, misleading, infringing, libelous, defamatory or otherwise violates any law or right of any third party;
  2. for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
  3. to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any ALD user;
  4. to violate any laws in your jurisdiction (including but not limited to copyright laws);
  5. to submit stories or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content.

ALD may remove any Content and ALD accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. To report Terms of Use abuse, please email: laserexec@laserdentistry.org
You are solely responsible for your interactions with other users of the Site. ALD reserves the right, but has no obligation, to monitor disputes between you and other users.

  1. COPYRIGHT COMPLAINTS

ALD respects the intellectual property of others. It is ALD’s policy to respond expeditiously to claims of copyright and other intellectual property infringement. ALD will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, ALD may act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. ALD will terminate access for subscribers and account holders who are repeat infringers.
Notifying ALD of Copyright Infringement: To provide ALD notice of an infringement, you must provide a written communication to the attention of “DMCA Infringement Notification Dept.” care of laserexec@laserdentistry.org that sets forth the information specified by the DMCA (http://www.copyright.gov/title17/92chap5.html#512).

 

  1. ALD PRIVACY POLICY

ALD’s current Privacy Policy is incorporated by this reference.

  1. INDEMNITY

You will indemnify and hold harmless ALD, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms & Conditions by you, or the infringement by you, or any third party using your account or ALD Password, or any intellectual property or other right of any person or entity.

You acknowledge that ALD has no control over, and no duty to take any action regarding: which users gain access to the Site or use the Services; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release ALD from all liability for you having acquired or not acquired Content through the Site or the Services. The Site or Services may contain, or direct you to sites containing information that you may or may not find helpful. The ALD has attempted to provide useful links to helpful sites.  ALD has no control over third party sites and resources for which it provides links.  You acknowledge and agree that ALD is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that ALD shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

  1. LIMITATION OF LIABILITY

IN NO EVENT SHALL ALD BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR OTHER LEGAL THEORY (I) WITH RESPECT TO THE SITE, THE SERVICE OR ANY CONTENT FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), OR (II) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) $100.

  1. TERMINATION

ALD may terminate or suspend any and all Services and your ALD Membership immediately, without prior notice or liability, if you breach any of the terms & conditions Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your Membership account, you may simply opt out of Public Member Directory and discontinue using the Services. All provisions of the Terms & Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

  1. MISCELLANEOUS

No agency, partnership, joint venture, or employment is created as a result of the Terms & Conditions and you do not have any authority of any kind to bind ALD in any respect whatsoever. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. ALD shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond ALD’s reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including “line-noise” interference). If any provision of the Terms & Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms & Conditions shall otherwise remain in full force and effect and enforceable. The Terms & Conditions is not assignable, transferable or sublicensable by you except with ALD’s prior written consent. ALD may transfer, assign or delegate the Terms & Conditions and its rights and obligations without consent. The Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Illinois as if made within Illinois between two residents thereof, and the parties submit to the exclusive jurisdiction of the Cook County courts and the United States District Court for the Northern District of Illinois. Both parties agree that the Terms & Conditions is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of the Terms & Conditions, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.

  1. TRADEMARKS

ALD graphics, logos, designs, page headers, button icons, scripts, and service names are trademarks or trade dress of ALD in the U.S. and/or other countries. ALD’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion.
The Academy of Laser Dentistry and its officers, employees and agents assume no responsibility for consequences resulting from the use of the information herein, or in any respect for the content of such information, including, but not limited to, errors or omissions, the accuracy or reasonableness of factual or scientific assumptions, studies or conclusions, ownership of copyright or other intellectual property rights, and the violation of property, privacy or personal rights of others. No guarantees or warranties of merchantability or fitness for a particular use or purpose are made by the ALD with respect to such information.

Accordingly, we have developed this policy in order for you to understand how we collect, use, communicate and make use of personal information. The following outlines our privacy policy. We are committed to keeping your e-mail address confidential.  We do not provide emails to third parties, but emails of ALD members are included on www.laserdentistry.org in the Dental Directory.  ALD members are listed in the Dental Directory on www.laserdentistry.org so that you may be found by people seeking a laser dentist.  Internally, we will use your e-mail address solely to provide timely information about the Academy of Laser Dentistry. We will maintain the information you send via e-mail in accordance with applicable federal law.

How We May Use Information We Collect

ALD may use your contact information to alert you to new information, products and services, events and other opportunities.  Broadly speaking, we use personal information for purposes of administering our business activities, providing customer service and making available other items and services to our members and prospective members. Academy of Laser Dentistry will not obtain personally-identifying information about you when you visit our site, unless you choose to provide such information to us, nor will such information be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection. We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or for the protection of our legal rights. From time to time, we may also make your contact information available to other reputable organizations whose products or services we think you might find interesting.  We have instituted opt-out capabilities to ensure that you do not receive unwanted communication.

Mailing List Policy – Postal

We do not provide email addresses to any third party.  The individual or corporation requesting the use of the ALD Membership postal mailing list must submit in writing the purpose for which the list is to be used including a mailing sample and pay the applicable fee. The postal mailing list may be provided by either electronic mail or by labels as requested.

  1. ALD will include the following member data: Name of healthcare provider or corporate member; practice address; phone number; fax number; E-mail address; web site.
  2. The individual or corporation requesting the use of the mailing list must submit in writing the purpose for which the list is to be used. Samples of the material being mailed will be sent to the Academy of Laser Dentistry. Applicants must agree that the list will be used only for transferring the materials that are pre-approved by ALD.
  3. The list may be provided electronically or by providing pre-printed labels or both.
  4. The applicable fee must be paid in advance.
  5. Limited Use: Any individual or corporation purchasing the list can use it as needed within a 6-month window of that purchase. Use of the list after the 6-month cut-off will require an additional fee and approval of materials.
  6. The individual or corporation receiving a list must guarantee in writing that they will not distribute the list to other organizations or individuals, even those who are members of ALD.

Opt-Out Policy

Individuals may at any time elect to opt-out so that they are not included in any mailing list data. The following opt-out capabilities are available on all forms: Occasionally ALD makes mailing lists available to other dental organizations or corporations on a special request basis. Each request for use must follow ALD’s Mailing List Policy above. If you prefer your mailing information remain for ALD use only, please contact us.

Your Rights

To help us keep our promise to respect your privacy, it is important when you wish to exercise your rights that you contact us via any of the means listed in the first section of this Privacy Policy.

If you do not want to receive e-mail, postal mail, telephone calls or faxes from us in the future, or if you do not want us to share your contact information in the manner described above, please provide us with your exact name, e-mail and postal addresses, phone and fax numbers and, if appropriate, ALD membership number. More about Ad Server Companies and Virtual Learning

ALD may partner with or have special relationships with ad server companies. We may, at times, run virtual learning programs for various educational courses. The information collected is used to assess course effectiveness and learner outcomes and is not made available to outside sources. With respect to security: We use industry-standard encryption technologies when transferring and receiving consumer data exchanged with our site. When we transfer and receive certain types of sensitive information such as financial information, we redirect visitors to a secure server and will notify visitors through a pop-up screen on our site. We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site or by US mail. When users choose to make payments via credit cards, we submit the information needed to obtain payment to the appropriate clearinghouses. We do not store or reuse this credit card information, unless you have given your authorization for us to do so.

We are not responsible for any health related information a visitor might provide.  We do not recommend providing personal health related information.
